1. General Provisions
These Terms (version 1.1) govern the use of the PingView service available at https://pingview.app.

2. Definitions
- Service: the PingView platform, web app, API, and related functionalities.
- User: a natural person or legal entity using the Service.
- Consumer: a user protected by mandatory consumer law.
- Account: an individual user account in PingView.
- Subscription: paid plan enabling access to premium features.
3. Service Scope and Nature

The Service is provided with due care on a best-effort basis and may be affected by technical constraints and third-party infrastructure.
4. Digital Service Conformity, Updates and Delivery
- The Service is provided in conformity with its description, functionality and documentation.
- If non-conformity occurs, we will remove it within a reasonable time.
- Consumers may request price reduction or withdraw where non-conformity is material and mandatory law so provides.
- We may provide updates (including security updates) that may change selected functionalities.
- We provide updates necessary to maintain conformity of the digital service.
- Lack of user cooperation in implementing updates may limit Service performance to the extent resulting from that omission.
- The Service is deemed delivered upon account activation, and paid feature upgrades are deemed delivered after payment confirmation.
5. Account Registration and Security
- You must provide accurate data and keep it up to date.
- You are responsible for account credentials and account activity.
- We may suspend access in case of abuse or security threats.
- Creating multiple accounts to bypass plan limits or restrictions is prohibited.
6. Acceptable Use Policy and Rate Limits
- Using the Service to attack systems, scan vulnerabilities without authorization, or monitor resources without rights is prohibited.
- Reselling, sublicensing, account sharing, reverse engineering, and unauthorized scraping are prohibited.
- We may throttle traffic, apply rate limits, suspend notifications/API, and impose temporary blocks in case of excessive load or abuse.
- If limits are repeatedly exceeded, we may refuse downgrade requests until usage is normalized.
7. Pricing, Billing and Subscription
- Current pricing is available at /en/pricing.
- Payments are processed by third-party providers (e.g., Stripe).
- Subscriptions renew automatically unless cancelled before period end.
- Cancellation stops renewal and does not shorten already paid period.
- Price changes are communicated at least 30 days in advance.
- In the case of payment disputes (chargebacks), account access may be suspended until resolution.
8. Consumer Rights and Withdrawal
Consumers may withdraw from the agreement within 14 days from conclusion, unless statutory exceptions apply.
Withdrawal statements should be sent to support@pingview.app.
9. Complaints and Refunds
Complaints can be sent to support@pingview.app.
We will respond without undue delay, no later than within 14 days.
EU consumers may use the ODR platform: https://ec.europa.eu/consumers/odr.
10. Intellectual Property
All rights to software, interface, trademarks, content, and documentation within the Service belong to the Service provider or its licensors.
11. Warranty Disclaimer, Liability and Force Majeure
The Service is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, total liability for non-consumer users is limited to fees paid in the preceding 12 months.
We are not liable for failures caused by force majeure or third-party infrastructure beyond our control (including cloud outages, DNS/CDN incidents, payment operator outages, DDoS attacks, or administrative actions).
12. Data Protection and User Data
Data processing rules are described in the Privacy Policy.

Users are responsible for maintaining their own backups of configuration and operational data exported from the Service.
Technical backups maintained by us are for service continuity and security only and do not constitute customer archival storage.
13. Duration, Suspension and Termination
The agreement is concluded for an indefinite period upon account creation.
Users may terminate at any time by deleting the account or contacting support.
We may terminate or suspend the agreement for important reasons, including material breach of Terms, abuse, repeated excessive load, non-payment, or unresolved chargeback disputes.
Unless immediate action is required for security or legal reasons, termination by us is made with a 14-day notice period.
After account deletion, active data is removed within 30 days and backup retention may extend up to 90 days.
14. Service Availability (SLA)
Target platform availability is 99.9% monthly for paid plans.
SLA excludes planned maintenance, force majeure, third-party failures, and free-plan accounts.
15. Changes to Terms
We may amend these Terms for legal, technical, security, or business reasons. Material changes are communicated at least 14 days in advance.
16. Governing Law and Disputes
These Terms are governed by Polish law.
Court jurisdiction is determined under mandatory law; for non-consumers, disputes are resolved by the competent court for the Service provider seat.
17. Final Provisions
If any provision is held invalid, the remaining provisions remain in force.
This version enters into force on 12.02.2026.
