§ 1

General Provisions & Service Provider Details

These Terms of Service (version 1.2) set forth the rules and conditions for using the SaaS monitoring service PingView, available online at https://pingview.app, provided electronically pursuant to the Polish Act on Providing Services by Electronic Means of 18 July 2002.

These Terms are made available free of charge prior to contract conclusion in a format enabling storage, downloading, and reproduction.

§ 2

Definitions

Whenever used in these Terms of Service, the following capitalised terms have the meaning defined below:

PingView Service / Platform:
Cloud-based Software-as-a-Service (SaaS) platform, web application, probe network, API endpoints, incident alert systems, and public/private status pages.
User / Customer:
A natural person, legal entity, or unincorporated organizational unit utilizing the Service.
Consumer & Protected Sole Proprietor:
A natural person entering into a contract not directly related to their business/professional activity (Art. 22[1] of the Polish Civil Code), as well as a natural person running a sole proprietorship where the contract lacks professional character (Art. 385[5] Polish Civil Code).
Account:
Individual workspace in PingView protected by authentication credentials (password, 2FA).
Subscription / Plan:
A free or paid service tier specifying monitor limits, check frequencies, retention periods, and advanced features pursuant to the current Pricing.
SLA (Service Level Agreement):
Our operational availability commitment for the PingView core platform for paid subscription plans.
§ 3

Scope and Nature of Services

PingView provides synthetic uptime diagnostics, performance analytics, and notification services including:

  • uptime and response time monitoring for websites (HTTP/HTTPS)
  • API endpoint availability and performance monitoring (REST, GraphQL, webhooks)
  • SSL/TLS certificate expiration tracking and validity checks
  • DNS record and nameserver resolution monitoring
  • network port (TCP/UDP) and VPS/server availability checks
  • domain registration and expiration monitoring (WHOIS)
  • synthetic monitoring, user journeys, and checkout transaction tests
  • Real User Monitoring (RUM) and Core Web Vitals analytics
  • multi-channel incident notifications (email, SMS, Webhooks, Slack, Discord, Telegram)
  • public and private status pages with custom domains and SLA analytics

PingView acts as a synthetic diagnostics and monitoring tool. The Service is provided with professional due care (best effort) and SLA commitments specified in § 14.

§ 4

Technical Requirements

To properly use the Service, the User must meet the following minimum technical requirements:

  • Device with active access to the Internet;
  • Up-to-date web browser supporting HTML5, JavaScript, cookies, and TLS 1.2+ (e.g., Google Chrome, Mozilla Firefox, Apple Safari, Microsoft Edge);
  • Active and correctly configured email account for verification and alerts;
  • For Webhook and API integrations: endpoint capable of receiving HTTPS requests and returning HTTP 2xx status codes.
§ 5

Digital Service Conformity, Delivery & Updates

  • The Service is supplied in conformity with its functional description, documentation, and the selected subscription tier (pursuant to Chapter 5b of the Polish Consumer Rights Act).
  • Delivery occurs immediately upon successful account creation (for Free tier) or upon confirmation of payment by the payment processor (for paid plans).
  • We provide continuous security updates and platform improvements necessary to maintain the integrity, security, and conformity of the digital service.
  • If non-conformity occurs, we will resolve it within a reasonable time without significant inconvenience to the User.
§ 6

Account Registration, Security & Credentials

  • Registration requires providing truthful, accurate, and current information.
  • The User is solely responsible for maintaining the confidentiality of their login credentials, passwords, and API keys.
  • Enabling two-factor authentication (2FA) is strongly recommended for enhanced workspace protection.
  • Creating multiple accounts (multi-accounting) to circumvent Free tier limits or system quotas is strictly prohibited.
§ 7

Acceptable Use Policy (AUP) & Abuse Prevention

Strictly Prohibited Activities:
  • Monitoring, probing, or scanning websites, servers, IP addresses, or APIs without having legal title, owner authorization, or administrative rights.
  • Launching Denial-of-Service (DoS/DDoS) attacks, automated spamming, or exploit/vulnerability scanning via PingView probes.
  • Unauthorized reverse engineering, decompilation, scraping, resale, or sublicensing of the platform.

To protect platform stability and third-party systems, PingView reserves the right to apply dynamic rate limiting, pause malfunctioning probes, or temporarily suspend accounts in breach of this policy.

§ 8

Pricing, Billing & Subscriptions

  • The current subscription fees and feature packages are listed at /en/pricing. Prices are expressed in PLN, EUR, or USD and clearly state applicable VAT.
  • All online payments are securely processed by Stripe, Inc. (PCI-DSS Level 1 certified).
  • Subscriptions automatically renew at the end of each billing cycle (monthly or annual) unless cancelled by the User before the renewal date.
  • Cancellation stops future renewals; full access to paid features remains active until the end of the current pre-paid cycle.
  • Electronic VAT invoices are issued automatically and made available in the billing dashboard and sent via email.
  • In case of payment disputes (chargebacks), account access may be paused pending dispute resolution with the payment provider.
§ 9

Consumer Right of Withdrawal (14-Day Period)

Statutory 14-Day Withdrawal Right:

Pursuant to Art. 27 of the Polish Consumer Rights Act, a Consumer (or protected sole proprietor) may withdraw from the agreement within 14 calendar days from conclusion without stating any reason and without incurring any costs.

To exercise withdrawal, submit an explicit statement via email to: [email protected].

If the Consumer expressly consented to immediate service performance during the withdrawal period and the digital service was fully executed, the right of withdrawal expires pursuant to Art. 38 point 1 of the Consumer Rights Act.

§ 10

Complaints & Technical Support

Complaints regarding service operations or billing may be submitted electronically to:

  • We examine and respond to all complaints within 14 calendar days from receipt.
  • EU consumers may also resolve cross-border disputes via the European ODR platform at https://ec.europa.eu/consumers/odr.
§ 11

Intellectual Property & License

All rights, titles, and intellectual property rights in PingView (source code, architecture, UI design, trademarks, and documentation) are owned exclusively by the Service Provider or its licensors.

Users are granted a non-exclusive, non-transferable, revocable license to access and use the Service for the duration of the active subscription.

Telemetry logs, diagnostic data, and configuration parameters created by the User remain the User’s property and may be exported at any time.

§ 12

Liability Disclaimer, Warranty & Force Majeure

  • In relations with non-consumer business users (B2B), the Service is provided on an "as is" and "as available" basis, and statutory warranty for defects (rękojmia) is excluded to the fullest extent permissible by law (Art. 558 § 1 Polish Civil Code).
  • To the maximum extent permitted by law, our total aggregate liability towards non-consumer users is limited to the fees actually paid by the User in the 12 months preceding the incident.
  • Neither party is liable for failure or delay resulting from Force Majeure events or external third-party outages beyond reasonable control (including cloud provider outages, Tier-1 ISP fiber cuts, global DNS disruptions, or state regulatory actions).
§ 13

Personal Data Protection (GDPR)

Detailed terms regarding personal data processing and cookies are set forth in our Privacy Policy.

Active operational data is deleted within 30 days of account removal; backup archive retention does not exceed 90 days.

§ 14

Service Level Agreement (SLA)

Monthly Target Availability: 99.9%

We target 99.9% monthly availability for the PingView core platform for all active paid subscription plans.

SLA Exclusions:

  • Scheduled maintenance windows announced at least 24 hours in advance;
  • Force Majeure events and global Internet infrastructure disruptions;
  • Accounts on Free or Trial tiers.
§ 15

Duration, Suspension & Termination

  • The agreement is concluded for an indefinite period upon account creation.
  • The User may terminate the agreement at any time by deleting their Account in settings or contacting support.
  • We may terminate the agreement with a 14-day notice period for valid reasons (such as service deprecation or business cessation).
  • We reserve the right to immediately suspend or terminate accounts engaging in gross violations of these Terms, illegal conduct, or non-payment.
§ 16

Amendments to Terms

We may amend these Terms for valid legal, regulatory, security, or technical reasons. Users will be notified of material amendments via email or in-app notification at least 14 days before changes take effect.

If the User does not accept the amended Terms, they may terminate the agreement prior to the effective date without incurring fees.

§ 17

Governing Law & Dispute Resolution

These Terms and all agreements concluded under them are governed exclusively by the laws of the Republic of Poland.

Any disputes arising with non-consumer business users shall be resolved exclusively by the common court having territorial jurisdiction over the Service Provider seat (Wrocław, Poland).

If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.

§ 18

Final Provisions

This version 1.2 of the Terms of Service enters into force on 12.02.2026.
